These Terms of Use (the "Terms") govern your access to and use of FluentBoo's website, mobile application, and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. You also agree to our Privacy Policy: https://fluentboo.com/privacy

If you do not agree to these Terms, do not use the Service.

1) Who We Are

The Service is provided by FluentBoo ("FluentBoo," "we," "us," or "our").

2) Eligibility

You must be able to form a legally binding contract in your jurisdiction to use the Service.

If you are under the age of majority where you live, you may use the Service only if a parent or legal guardian agrees to these Terms on your behalf and is responsible for your use.

3) Your Account

To use certain features, including syncing your progress, you may need to create an account or sign in.

You agree to provide accurate account information, keep it up to date, maintain the confidentiality of your login credentials, and notify us promptly of any unauthorized access to your account. You are responsible for all activity that occurs under your account.

4) The Service

FluentBoo is a language-learning service designed to help you build vocabulary and practice language skills. The Service may include saving words and translations, tracking learning progress, AI-assisted chat and language help, translation features, OCR or image-based text extraction, offline-capable learning tools, push notifications, and related learning experiences.

The Service may evolve over time. We may add, remove, or modify features.

5) License to Use the Service

Subject to these Terms, FluentBoo grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial language-learning purposes.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or attempt to extract source code from any part of the Service except where permitted by law. You may not interfere with or disrupt the Service, our systems, or our security controls.

6) Your Content and Inputs

The Service may allow you to enter, upload, or submit content such as words, translations, notes, chat messages, and images for OCR ("User Content").

You retain ownership of your User Content. You grant FluentBoo a worldwide, royalty-free, non-exclusive license to host, store, reproduce, process, and display your User Content only as needed to provide and operate the Service, sync your data across devices, maintain backups and restore functionality, and improve reliability, safety, and performance.

You are responsible for your User Content and represent that you have all rights needed to submit it, that it does not violate any law or third-party rights, and that it does not contain harmful or malicious code. Do not submit sensitive personal data, government ID numbers, financial account numbers, or content you do not have permission to share.

7) AI Features and Output Disclaimer

Some features may generate outputs using AI, including chat responses, suggestions, translations, and learning content ("AI Output").

AI Output may be inaccurate, incomplete, or inappropriate. AI Output is provided for general educational use and is not professional advice, including medical, legal, financial, or safety advice. You are responsible for how you use AI Output and for verifying it independently when needed.

8) OCR and Image-Based Features

If you use OCR features, you may provide images or image data, including photos, screenshots, or documents, for text extraction.

You agree that you will only upload images you have the legal right to use, that you will not upload illegal content or content that violates privacy or intellectual property rights, and that OCR results may be imperfect.

9) Subscriptions, Purchases, Billing, and Auto-Renewal

The Service may offer paid subscriptions and one-time in-app purchases. Subscription names, durations, prices, and included benefits are shown in the app before purchase and may vary by country, currency, platform, and current offer availability.

FluentBoo subscriptions may include plans such as Pro or Max with weekly, monthly, or yearly billing periods. The purchase screen displays the subscription title, subscription length, price, and any price-per-period information required by the app store before you confirm the purchase.

Purchases are processed through the app store on your device, such as the Apple App Store or Google Play. We may use a third-party subscription infrastructure provider, such as RevenueCat, to manage subscription status and entitlements.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period. Your account may be charged for renewal within 24 hours before the end of the current period, according to the applicable app store's rules. You can manage or cancel subscriptions through your Apple App Store or Google Play account settings.

If a free trial or promotional offer is available, it will be disclosed before purchase. Unless canceled at least 24 hours before the end of the trial or promotional period, the subscription will convert to a paid auto-renewing subscription at the disclosed price.

Prices may vary by region and may include applicable taxes. Refund requests are handled by the app store that processed the purchase and are subject to that store's refund policies. FluentBoo cannot directly issue refunds for purchases processed by Apple or Google unless required by law.

If available, you may restore purchases using the restore function in the app or through your app store account.

10) Ads and Third-Party Advertising

Some versions of the Service may display advertisements or offer rewarded ads. Ads may be provided by third-party partners and may be tailored based on limited information as permitted by your device settings and applicable law. You can often control ad personalization through your device privacy settings.

11) Acceptable Use

You agree not to use the Service for unlawful, harmful, abusive, harassing, threatening, exploitative, infringing, or fraudulent purposes. You also agree not to bypass usage limits, security measures, or access controls; upload malware; overload the Service; scrape or harvest data at scale without permission; or use the Service to generate or distribute illegal or infringing content.

We may investigate and take action, including suspending or terminating accounts, if we believe you have violated these Terms.

12) Data Storage, Sync, and Backups

The Service may store data locally on your device and/or in the cloud for syncing across devices and restoring data. We may provide tools that allow you to export or restore backups. You are responsible for keeping your own copies if you need guaranteed retention.

We do not guarantee that data will never be lost, corrupted, or deleted.

13) Third-Party Services

The Service may rely on third-party services, including hosting, authentication, subscription management, advertising, notifications, OCR processing, AI processing, analytics, and app store billing.

Your use of those features may be subject to third-party terms and policies. FluentBoo is not responsible for third-party services, and they may change or discontinue independently of us.

14) Intellectual Property

The Service, including its software, design, text, graphics, logos, and other content excluding User Content, is owned by FluentBoo or its licensors and is protected by intellectual property laws.

You may not use FluentBoo's branding, logos, or trademarks without our written permission.

15) Feedback

If you provide feedback, suggestions, or ideas, you grant us the right to use them without restriction or compensation, including to improve the Service.

16) Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms, if we are required to do so for legal reasons, or if your use poses a risk to the Service, other users, or third parties.

Termination may result in loss of access to your data, subject to applicable law and any backup or export tools that may be available.

17) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUENTBOO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT RESULTS INCLUDING AI OUTPUT, TRANSLATIONS, OR OCR WILL BE ACCURATE OR RELIABLE, OR THAT ANY DATA WILL BE SECURE OR NOT LOST.

18) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUENTBOO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUENTBOO'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO FLUENTBOO FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $10 IF YOU PAID NOTHING.

Some jurisdictions do not allow certain limitations. In those jurisdictions, our liability will be limited to the extent permitted by law.

19) Indemnification

You agree to defend, indemnify, and hold harmless FluentBoo and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, your User Content, your violation of these Terms or applicable law, or your infringement of any third-party rights.

20) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, for example by posting updated Terms on our website or in the app.

Your continued use of the Service after updated Terms become effective means you accept the changes.

21) Privacy

Your use of the Service is also subject to our Privacy Policy.

22) Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, excluding its conflict-of-law rules.

Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Delaware, United States, unless applicable consumer law requires a different forum.

If you are a consumer, you may have additional rights under the laws of your country.

23) Apple App Store Additional Terms

If you download or use the Service through the Apple App Store, Apple is not a party to these Terms and has no obligation to provide maintenance or support for the Service. Apple is not responsible for claims relating to the Service, including product liability claims, claims that the Service fails to conform to applicable legal or regulatory requirements, or claims under consumer protection laws.

Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the Service through the Apple App Store and may enforce these Terms against you as a third-party beneficiary.

24) Miscellaneous

If any provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms as part of a merger, acquisition, sale of assets, or by operation of law.

These Terms and any referenced policies are the entire agreement between you and FluentBoo regarding the Service.
